Digital Millennium Copyright Act Notice and Takedown Procedure

EZPrintHouz respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we have implemented the following policy to address claims of copyright infringement related to user-uploaded files processed through our DTF printing services.

Our Content and Customer Uploads

EZPrintHouz offers two types of content:

  1. Our own designs created or legally licensed by EZPrintHouz
  2. Customer-uploaded files for DTF printing services

While we maintain full rights to our own designs, we cannot pre-screen all customer uploads for potential copyright infringement. We rely on our notice and takedown procedure to address potential intellectual property violations.

Notification of Claimed Copyright Infringement

If you believe that your copyrighted work has been copied and is being used in a customer-uploaded file processed through our services in a way that constitutes copyright infringement, please send a written notification containing the following information to our designated DMCA agent:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has allegedly been infringed;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material that is claimed to be infringing, including order information or other details sufficient to permit EZPrintHouz to locate the specific customer file;
  4. Information reasonably sufficient to permit EZPrintHouz to contact the complaining party, such as an address, telephone number, and email address;
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification Procedure

If you are a customer whose upload was removed or disabled and you believe this was done as a result of a mistake or misidentification, you may submit a counter-notification to our designated agent containing the following information:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which EZPrintHouz may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a proper counter-notification, EZPrintHouz will promptly provide the person who submitted the original DMCA notification with a copy of the counter-notification and will inform them that EZPrintHouz will reinstate the processing of the removed file in 10 business days. EZPrintHouz will reinstate processing between 10 and 14 business days following receipt of the counter-notification, unless our designated agent first receives notice that the original complainant has filed an action seeking a court order to restrain you from engaging in infringing activity.

Repeat Infringer Policy

In accordance with the DMCA, EZPrintHouz has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also limit access to our services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
